That was OPM's original ruling, until Senate Democrats panicked, went to President Obama, asked for relief. And so President Obama said, worry, I'll talk to OPM. We'll come up with a rule to circumvent the law unconstitutionally. Again, the Constitution gives the president no power to either enact, amend, or repeal laws, and that's what he's doing.
