It is ironic, one could say hypocritical, and deeply so for the party of unlimited federal power that distorted the vertical protection of federalism and with it the horizontal protection of separation of powers. We have never retreated from that position. And As soon as we gave Congress the power to regulate anything and everything that messed up the vertical protection of federalism, we started messing up the horizontal protection of separation of powers. Because no sooner had we as senators and congressmen gotten all this new power that we started saying, holy crap, I'm going to have to work a lot harder and I'm going to have to take a lot more votes.
