I don't know what's difficult to reconcile about them. I think that the founders did. You can read the writings of the founders when they crafted the Constitution originally in The founders intended that the judiciary be there to arbitrate claims, but not to be making policy. And in a certain way, that makes them weaker than the other branches that get to put forth policy that affects our nation's future. The courts weren't designed to do that. (50:03–50:21)
