Now, if DOE implemented the FY 2025 spend plan, the Department would be in clear violation of the Anti Deficiency Act. GAO clearly states, and again I quote, to the extent that DOE obligated or expended FY2025 funds in excess of appropriate amounts, I.e. the FY2024 levels described above. DOE should report an Anti Deficiency act violation. I'm interested whether that occurred. GAO says they are unable to make a final determination of whether the Department actually violated the law because DOE has not provided adequate information or an explanation concerning the source of funds to enable a determination.
