Well, what the judicial rules require any judge to do, and what I do now as a circuit court judge, is to, bottom line, look at whether I can be fair and impartial in a case. There are some circumstances where recusal is mandatory, like if the judge has some personal stake in the outcome of a case, a financial stake, knows one of the parties involved in the case, or has a close relationship with them. Otherwise, what the law requires is for a judge to make a determination on whether they can be fair and impartial. (06:37–06:53)
