Well, they wanted to use eminent domain to take and use people's land. Whether they wanted to have it used or not, they would come in and they would sue you to condemn your land. There were hundreds of South Dakota landowners that were trying to get sued by Summit Carbon Solutions to come take their land. and use it without their consent.
